Chapter 7 is a federal debt relief process that discharges most unsecured debts, including credit card balances, medical bills, personal loans, collection accounts, and payday loans. It doesn’t eliminate every obligation: child support, alimony, most student loans, and most tax debts survive a Chapter 7 discharge. But for individuals carrying significant unsecured debt with limited income, it can provide a genuine reset.
Filing a Chapter 7 petition triggers an automatic stay, which immediately halts creditor calls, wage garnishment, foreclosure proceedings, and vehicle repossession. Chapter 7 is sometimes called liquidation bankruptcy because a trustee may sell non-exempt assets to pay creditors. In practice, Virginia exemptions protect many common assets, and most filers keep the majority of their property.
Chapter 7 Eligibility in Virginia
Qualifying for Chapter 7 starts with the means test, which compares your household’s average monthly income to the Virginia median income for a household of your size. If your income falls below the median, you typically qualify. If it’s above, a detailed expense deduction analysis determines whether your disposable income is low enough to still proceed.
Two filing-history bars also apply. You can’t receive a Chapter 7 discharge if you received one in the past eight years, and a prior Chapter 13 discharge may bar you from filing within six years, though exceptions apply depending on how much you repaid creditors in that earlier case. Before filing, you must complete a credit counseling course from an approved agency within the prior 180 days. A debtor education course is also required after filing before discharge is granted.
The Chapter 7 Process: Consultation to Discharge
We begin by reviewing your full debt picture to identify which debts are likely dischargeable and which property may be protected under Virginia exemptions. From there, we gather the financial documents needed to build your petition: income statements, tax returns, and a complete list of debts and assets.
Once we file your petition with the U.S. Bankruptcy Court for the Western District of Virginia, a bankruptcy trustee is appointed to review your case. About a month after filing, you’ll attend a 341 meeting of creditors, where the trustee asks questions about your financial situation under oath. We prepare you for that meeting and attend with you. Most Chapter 7 cases in Virginia reach discharge within four to six months of filing, though timelines vary by case. Upon request, we also send written notice to creditors that you’ve retained an attorney, which can help reduce direct collection contacts while your case is pending.
