Your Rights Under the Fair Debt Collection Practices Act

The Fair Debt Collection Practices Act (FDCPA) is a federal law that prohibits abusive, unfair, or deceptive practices by third-party debt collectors. It applies to consumer debts like credit card balances, medical bills, and personal loans. Under the FDCPA, collectors must follow strict rules about when, how, and how often they can contact you.

Prohibited contact practices include:

Calling before 8 AM or after 9 PM
Using profane or abusive language
Threatening legal action they don’t actually intend to take
Discussing your debt with family members or your employer (with narrow exceptions)

Under Consumer Financial Protection Bureau (CFPB) rules, a collector is presumed to violate the law if they call about the same debt more than seven times within a seven-day period, or within seven days after speaking with you about that debt. You also have the right to send a written request directing a collector to stop contacting you. Once received, they must comply. Separately, you can request written verification of the debt, and collection activity must pause until that verification is provided.

Steps You Can Take Right Now

You don’t have to wait for an attorney to take some steps on your own, though having counsel makes each of them more effective.

Keep a Contact Log
Write down the date, time, caller’s name or company, and what was said during every collector contact. This record is the foundation of any FDCPA claim.

Send a Written Cease Communication Request
Once a collector receives this request in writing, federal law obligates them to stop most contact. When an attorney sends this letter on your behalf, future collector communication can be redirected to counsel, taking you out of the middle entirely.

Request Debt Verification
You have the right to ask for written proof of the debt. The collector must pause collection activity until they provide it, giving you time to assess your options.

File a CFPB Complaint
The Consumer Financial Protection Bureau accepts complaints online, forwards them to the company involved, and requires a response. It’s a straightforward step that creates a formal record.

One important caution: stopping collector contact doesn’t resolve the underlying debt. A collector who can’t call you can still sue you. Addressing the debt itself through negotiation, a payment arrangement, or bankruptcy is what can produce lasting relief. Under the FDCPA, consumers who prevail on a harassment claim may recover actual damages, statutory damages of up to $1,000, and attorney fees, which means a meritorious claim may involve little or no out-of-pocket cost to pursue.

How Bankruptcy Stops Collector Contact

For some clients, the harassment is a symptom of a deeper problem: debt that can’t realistically be repaid. When that’s the case, filing for bankruptcy may be an effective response to both issues at once.

Filing a bankruptcy petition immediately triggers the automatic stay, a federal court order that halts virtually all collection activity the moment the petition is filed. Calls stop. Letters stop. Wage garnishment stops. Pending lawsuits pause. The automatic stay takes effect before creditors even receive formal notice of the filing. Any creditor who continues contact after being informed of the case number may face court-ordered sanctions, including actual damages, attorney fees, and in appropriate circumstances, punitive damages.

Not every harassment situation calls for bankruptcy. Some are fully resolved through FDCPA enforcement alone. Others involve debt that Chapter 7 bankruptcy can discharge entirely, or a payment plan under Chapter 13 bankruptcy can make manageable.
