How Virginia Defines Reckless Driving

Virginia law creates two main pathways to a reckless driving charge. Virginia Code § 46.2-862 makes it a criminal offense to drive 20 mph or more over the posted speed limit, or to exceed 85 mph regardless of the posted limit. No proof of intent is required. The Commonwealth only needs to prove the speed itself.

The second pathway, Virginia Code § 46.2-852, covers general reckless driving: operating a vehicle in a manner that endangers life, limb, or property. This applies to a wide range of conduct beyond speed alone.

Both offenses are classified as a Class 1 misdemeanor, the most serious misdemeanor classification under Virginia law.

Penalties a Conviction Can Carry

A reckless driving conviction carries up to 12 months in jail, a fine of up to $2,500, and a driver’s license suspension of up to six months. Courts may grant a restricted license for limited purposes such as work, school, or medical appointments during a suspension, but that outcome isn’t guaranteed.

A conviction adds six demerit points to your Virginia driving record, the highest number assigned for a single offense, and that entry stays on your record for 11 years.

Criminal Record
Because reckless driving is a criminal conviction rather than a traffic infraction, it becomes part of your permanent record. Virginia’s expungement law generally doesn’t allow removal of a conviction, though in some cases a conviction may later be eligible for record sealing, which can limit who sees it on a background check.
